Before you can even think about hiring a worker on a sc482 visa, your business needs to be approved as a Standard Business Sponsor. This is the foundation of the entire process, and it’s crucial to get it right.

The Standard Business Sponsorship application involves demonstrating that your business is legally established and actively operating in Australia. You’ll need to show your commitment to employing overseas workers under fair terms and conditions and that you can meet your sponsorship obligations.

Your migration agent will guide you through this process, helping you gather and submit the necessary documentation. This includes proof of your business’s financial health, compliance with Australian laws, and evidence that you’ve actively sought to hire locally before looking overseas.

The Standard Business Sponsorship application typically takes about 2 to 4 weeks to process. Once approved, this sponsorship status allows your business to nominate skilled workers for a sc482 visa, paving the way for bringing in the talent you need.

Job Position Identification:

1-3 weeks

Let’s start with the first step: Job Position Identification. This is where you get clear on what you need. Think about the role you’re looking to fill, the skills required, and the qualifications necessary. It’s about being methodical and systematic about the gaps you’re facing. Labour Market Testing (LMT):

28 days for advertising, 1 week to compile applicants

Labor Market Testing (LMT) is a crucial part of the sponsorship application process for the sc482 visa. It’s like proving to the authorities that you’ve done your homework and genuinely tried to find a local worker before looking overseas. During the advertising period, you need to keep track of all the applications and responses you receive. This involves noting down the number of applicants, their qualifications, and why they were not suitable for the role. We recommend compiling the applicants into a report that is submitted with copies of the job ads and advert payment receipts.

Unfortunately this is the part of the process I’ve seen so many disasters. Clients who have tried to undertake LMT themselves, only to face a refusal from the Department of Home Affairs as they missed a technicality and the LMT was not valid. This means the candidate’s visa won’t be granted and fees (including expensive levy’s) are lost. We charge $600 for LMT services. The risk is several thousand if you get it wrong.

Professional hack: Labour Marketing Testing has to run for 28 days and is valid for 4 months. If you are considering hiring a worker on a sponsored sc482 visa, and know the position. get your Labour Market Testing posted straight away. There is no need to wait until you’ve found your candidate. Your migration agent should be able to coordinate this for you.

Nomination Application:

1-4 weeks

Now that you’ve got your sponsorship approval, it’s time to move on to the Nomination Application. This is where your migration agent steps in to advocate for your ideal candidate. They’ll handle the process of nominating the specific overseas worker for the job, ensuring that all the details are in place.

Your migration agent will provide detailed information about the job, including the duties, location, and salary, and explain why this particular candidate is the best fit. They’ll also make sure that all necessary requirements, like Labor Market Testing, have been met, proving that you’ve tried to fill the role locally first.

The nomination application process, managed by your migration agent, can take approximately 2 to 6 weeks, depending on the complexity of the case. This stage is all about demonstrating that you’re not just filling a gap but making a thoughtful and informed decision to bring in the right talent for your team, with the expertise of a migration agent guiding the way.

Professional hack: The nomination application preparation process can start as soon as the LMT is posted. Get your agent to prepare whatever they can as soon as they can.

Visa Application

1-4 weeks

Finally, we come to the Visa Application stage. This is where your nominated worker applies for the sc482 visa, and having a migration agent by your side can make all the difference.

Your migration agent will walk your worker through the entire application process, ensuring all the necessary documents are in order. This includes personal information, proof of qualifications, work experience, and health and character checks. For the most current processing times, you can check the Department of Home Affairs visa processing time webpage. However these timings include all occupations and all applications (the good, the bad and the ugly). So whilst this resource is a true statement, it’s also not always relevant. Our most recent visa applications have been granted just a few days after the corresponding company nomination was approved.

Working with a migration agent during this stage ensures that all requirements are met and increases the likelihood of a smooth and successful outcome. It’s about trusting the process and knowing that you’ve got the right support to make it happen.
